1. Eligibility & Accounts

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Please notify us immediately of any unauthorized use.

2. Acceptable Use

• Comply with all applicable laws and platform policies (Meta/Facebook, LinkedIn, Twitter/X, etc.).
• No spamming, scraping beyond permitted API scope, or misrepresentation of identity.
• No uploading or generating content that is unlawful, harmful, infringing, hateful, or deceptive.
• No attempts to access or interfere with non-public areas of the Service or our infrastructure.
• Respect rate limits, automation rules, and content guidelines of each platform you connect.

3. Platform Integrations

The Service may integrate with third-party platforms (e.g., LinkedIn, Meta/Facebook, Instagram, Twitter/X). Your use of those platforms is governed by their respective terms and policies. We only access data and perform actions that you authorize and that are permitted by each platform. Platform access may be modified or revoked by the platform at any time.

4. Payments & Billing

Payments are processed securely by Stripe. By subscribing, you authorize Stripe to charge your payment method for recurring fees, taxes, and any applicable charges. We do not store full card numbers or CVV. Please review Stripe’s Privacy Policy.

5. User Content & License

You retain ownership of content you submit or generate using the Service. You grant us a limited, non-exclusive, worldwide license to host, process, and display such content solely to operate and improve the Service. You represent that you have all rights necessary to grant this license.

6. AI Features & Responsibility

AI-generated outputs may be imperfect or require human review. You are responsible for verifying content and ensuring compliance with laws and platform guidelines. PostEngageAI is not liable for outcomes resulting from automated actions you initiate or approve.

7. Intellectual Property

The Service, including software, UI, and trademarks, is owned by PostEngageAI and its licensors. Except as expressly permitted, you may not copy, modify, reverse engineer, or distribute any part of the Service.

8. Termination

We may suspend or terminate access to the Service at any time for violation of these Terms or for operational reasons. You may cancel your subscription at any time; cancellation does not entitle you to a refund unless required by law or our specific refund policy.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee results, uptime, or platform availability.

10. Limitation of Liability

To the maximum extent permitted by law, PostEngageAI and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Service.

11. Changes to the Service & Terms

We may modify or discontinue features at any time. We may update these Terms from time to time. The "Last updated" date reflects the most recent changes. Continued use of the Service constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws applicable to our principal place of business, without regard to conflict of laws principles. Disputes shall be resolved in the courts of that jurisdiction unless otherwise required by law.

14. Subscription, Trials & Renewals

Subscriptions renew automatically unless canceled before the renewal date. Trials may convert to paid plans unless you cancel before trial end. Pricing and plan features are posted on our site and may change.

15. Refunds & Cancellations

Except where required by law or a posted refund policy, fees are non-refundable. Cancellations take effect at the end of the current billing period. We may issue prorated credits at our discretion for service issues.

16. Taxes

You are responsible for any applicable taxes, duties, or levies associated with your purchases and use of the Service. Stripe may collect and remit taxes where required.

17. Support & Availability

We endeavor to provide reliable service but do not guarantee uninterrupted availability. Support channels and response times may vary by plan and are subject to change.

18. Third-Party Services & Links

Integrations and links to third-party services are provided as a convenience. Those services are governed by their own terms and privacy policies. We are not responsible for third-party content or actions.

19. Indemnification

You agree to defend, indemnify, and hold harmless PostEngageAI and its affiliates from any claims, damages, liabilities, and expenses arising from your content, your use of the Service, or your violation of these Terms or applicable laws.

20. Force Majeure

We shall not be liable for delays or failures due to events beyond our reasonable control, including acts of God, internet outages, platform changes, government actions, or labor disputes.

21. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations as part of a merger, acquisition, or asset transfer.

22. Notices

We may provide notices via email, in-app messages, or postings on the site. You are responsible for keeping your contact information current.

23. Severability

If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force and effect.

24. Waiver

A failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.
